LEGISLATORS INTRODUCE BILL TO CHANGE ADJUSTER LICENSING IN FLORIDA NEW PROPOSED LAW TO REQUIRE ADJUSTERS TO TAKE THE STATE TEST Currently, adjuster candidates who obtain an approved designation are exempt from taking the state licensing test. On February 24, 2015 two bills were introduced into the FL Legislature.

Don’t Mess With Texas Adjusters In Hail Damage Claims

Texas hail claim policyholder lawyers, like many plaintiffs’ lawyers, clearly prefer to be in state court rather than federal court. To accomplish this and prevent the defendant insurer from properly removing the lawsuit to federal court, Texas policyholder attorneys simply sue the adjuster (who, like the policyholder, is almost always a Texas resident). This common act of gamesmanship ostensibly destroys the complete diversity of citizenship required for federal court diversity jurisdiction, allowing the policyholder to litigate its hail damage claim in state court.

As of October 15, 2014, Governor Neil Abercrombie signed an emergency proclamation in anticipation of the arrival of Tropical Storm Ana, which is forecast to impact the state this weekend, possibly as a hurricane.

Declaration From The State Insurance Commissioner Regarding Assistance Of Nonresident Unlicensed Adjusters

Pursuant to Hawaii Revised Statutes (“HRS”) § 431:9-201(b), Insurance Commissioner Gordon I. Ito has determined that nonresident adjusters can operate in the state without a Hawaii license to assist with the anticipated amount of work that could be more than current capacity in the islands. 

The Insurance Division wants to ensure that adjusters and insurance companies will be able to respond to the homeowners' needs within a reasonable time.  Nonresident adjusters must comply with the following in order to operate in the state without a license pursuant to this statute for up to 30 days from the date of registration:  see the attached pdf for additional details

“The last hurricane that hit Hawaii was Hurricane Iniki in 1992, and Kauai took the brunt of the damage,” said Insurance Commissioner Gordon Ito. “Hurricane Iniki caused almost $2 billion in damages, which is about $3 billion in today’s dollars. It can take just one major storm to cause severe property damage, and we urge you to be prepared.”

Texas HB 272 - Relating to the operation of the Texas Windstorm Insurance Association

Highlights from the Bill

Deadline for Filing Claim: (1)require an insured to file a claim under the policy not later than the first anniversary of the date on which the damage or loss that is the basis of the claim occurs; The commissioner, on a showing of good cause by a person insured under this chapter, may extend the one-year period described by Subsection (a)(1) for a period not to exceed 90 days.

The association may not pay or settle a claim described by Subsection (a) unless the person filing the claim provides evidence satisfactory to the association that, on the date of the loss that is the basis of the claim, the property insured under the association policy was also covered by a flood insurance policy in the amount required for issuance or renewal of the association policy under Section 2210.203(a-1).
 
Not later than the 30th day after the date a person insured under this chapter files a claim with the association, the association shall provide the person notice of whether the claim is accepted or denied and, if the claim is accepted, a written appraisal of the damage to the insured property

To amend the National Flood Insurance Act of 1968 to provide for the national flood insurance program to make available multiperil coverage for damage resulting from windstorms or floods, and for other purposes.
