Christie Administration Announces Insurance Mediation Program to Expedite Sandy-Related Claims

Trenton, NJ - Continuing the Administration's commitment to assist New Jersey residents in swiftly resolving their Sandy-related insurance claims, Governor Chris Christie and New Jersey Department of Banking and Insurance (DOBI) Commissioner Ken Kobylowski announced the release of a Request for a Qualification (RFQ) to establish a new mediation process that gives consumers the option to settle disputed cases without resorting to costly and time consuming lawsuits.

"This process is needed to help alleviate the hardship being experienced by residents whose property was damaged or destroyed by Sandy," said Governor Christie. "As of February 15, the percentage of claims closed is now 87% overall and 91% for homeowners. This mediation program is an opportunity to expediently resolve outstanding claims so that residents can continue to rebuild their lives."

"Heavy rainfall over the weekend in southeast Saskatchewan has some communities struggling to keep up with the influx of water.

It's led to dangerous travel conditions after some highways were submerged or washed out, and several states of emergency were declared. 

The city of Melville called a state of emergency just before 9 a.m. CST after significant rainfall in the area.

Up to 15 other communities have also declared states of emergency."

Spring Outlook: Historic, widespread flooding to continue through May

"Nearly two-thirds of the Lower 48 states face an elevated risk for flooding through May, with the potential for major or moderate flooding in 25 states, according to NOAA’s U.S. Spring Outlook issued today. The majority of the country is favored to experience above-average precipitation this spring, increasing the flood risk.

Portions of the United States – especially in the upper Mississippi and Missouri River basins including Nebraska, Minnesota and Iowa – have already experienced record flooding this year. This early flooding was caused by rapid snow melt combined with heavy spring rain and late season snowfall in areas where soil moisture is high. In some areas, ice jams are exacerbating the flooding. Offices across the National Weather Service have been working with local communities, providing decision-support services and special briefings to emergency managers and other leaders in local, state and federal government to ensure the highest level of readiness before the flooding began."

Study: State insurance licensing reciprocity benefits everyone

A new study has found that the current system of licensing regulations for independent claims adjusters is causing more harm than help for the industry.

The study, entitled “Breaking Down Barriers” by Pacific Research Institute, found that the average claims adjuster holds between 10 and 12 different state licenses. This can set them back as much as $1,000 each. The study pointed out that these “costly, burdensome state requirements” make it more difficult for adjusters to operate across states, while driving up costs for consumers and limiting the opportunities for new adjusters.

At present, 34 states require independent adjusters to hold a license, the Association of Claims Professionals (ACP) reported.

(Reuters) - New York State has told its financial watchdog to investigate three insurance companies for dragging their heels when it comes to processing claims for damage caused by Superstorm Sandy that slammed the region last October.

New York State Governor Andrew Cuomo said in a statement that consumer complaints against Narragansett Bay Insurance Company, Tower Insurance Company and Kingstone Insurance Company received by the state's Department of Financial Services have been "much higher than average."

Hurricanes Harvey and Irma caused widespread flooding in Texas, Louisiana, the U.S. Virgin Islands, Puerto Rico, Florida, and the southeast United States. Due to the catastrophic impacts of these hurricanes and the increased demand for flood insurance adjusters, the Federal Emergency Management Agency (FEMA) is increasing the amount it will pay to adjust flood insurance claims.

The entire insurance industry is searching for qualified individuals to join the ranks of claims adjusters to handle losses from Harvey, Irma, and future events. FEMA recognizes the specialized knowledge required to properly adjust NFIP losses. Adjusters must know the differences between the Standard Flood Insurance Policy (SFIP) and private industry property insurance forms. They must know interpretations of coverage made by FEMA and the unique reporting requirements of the NFIP. Accordingly, FEMA maintains a list of adjusters authorized to handle NFIP losses.

Justices uphold Katrina fraud verdict against State Farm

"WASHINGTON — A unanimous Supreme Court on Tuesday upheld a jury verdict that State Farm Fire and Casualty Co. committed fraud against the federal government after 2005’s Hurricane Katrina.

The justices on Tuesday rejected claims by State Farm that the whistleblower case against the insurer should have been dismissed because its existence was leaked while it was supposed to be secret.

Justice Anthony Kennedy wrote for the court in upholding an appellate ruling that there is no requirement in federal law that the lawsuit be dismissed.

Sisters Cori and Kerry Rigsby filed the fraud lawsuit on behalf of the government after they said they witnessed State Farm shifting Mississippi claims to federal flood insurance that should have been paid by private wind insurance."

Sinno, a retired Mississippi State University professor, said State Farm Fire & Casualty Co. overlooked wind damage that would have been obvious to a sophomore engineering student.

Wind, he said, lifted up and twisted the house, as evidenced by a 45-degree crack in exterior brick that separated from the house."
