We / TDI & Others know:
Premium values are priced "right". Premium RCV / ACV math always gets back to supporting a G.C. business model expert. It has to. The premium / policy protected structure demands it for a worst case scenario.

Interestingly, illegal OHP retaining practices and premium rates are “high”, and coincidentally, so are insurers’ profits.
We feel homeowners should be encouraged to take carrier estimating practices and methodologies to appraisal. And not regarding scope and pricing issues so much, but rather regarding estimate structuring factors. Estimate structure methodology based on verifiable MSB, Simsol, Xactimate, DDS IntegriClaim, National Construction Estimator (w/ the 2004 Renovation & Insurance Repair Cost Book), etc. data constants, containing estimating structure norms, should help clear up some claim settlement issues. (Wear thick oven mitts for that "potato".)
So, should carrier recognized [G.C. business oriented] premium values receive unbiased treatment and be allowed to carry to single trade claim compensation settlements “handled” by a G.C. ? Sure. The G.C. anticipated values obviously exist...and were paid for...so why not…
Component based estimate data compared to other [recent] historical construction data is interesting reading. Promoters of unfair, uncompetitve, price fixing / market manipulation like cheaters are temporary irritations.

This is my first reply on CADO. I have been reading through all this and I'm still wondering why everybody wants CONMAN to go away, but you keep responding to his baiting?
While I have only been adjusting a couple of years, I am versed with some law background. The term "price fixing" is over-used here, what he is probably trying to suggest is the result of "price fixing" under the Sherman Anti-Trust Act, that result being "restraint of trade".
To suggest to an insured that they need to engage another contractor due to his bid not falling within the "estimated guidelines" used by a carrier is bad faith.
That does not mean an adjuster must roll over for a contractor who is clearly trying to retire on just one job, it does mean the adjuster must act in good faith and try and work with the insureds repair person to resolve all differences to a equitable conclusion as per the terms of the contract of insurance.

Wilbur: How would I be able to handle 5-7 each day if I had to get an agreed cost with the Insureds contractor, and most contractors don,t work on Sunday and I would lose a days production ? |

Here is how we resolve this problem. Upon getting to the storm office and after setting up, we call a minimum of 5 LOCAL roofing contractors and get their pricing for the different shingles. We take the 5 sets of prices, divided the total by 5 and come up with a mean average. 99% of the contractors agree with our scope and final estimate. We sometimes have a disagreement on squares, as we have found that more than half of the roofers use the old estimating system, "Looks like 32 squares to Me" from the ground. The is known as the (guess and bygosh) method of determining the amount of squares. |

Trader.....Not meaning to get sucked into an dispute here, but I don't think your production is relevant to the good faith owed an insured. I don't believe I said you needed to get an agreed cost with the insureds contractor. All I suggested is that the adjuster is duty bound to exhibit good faith in the adjustment of the claim being handled.
If that means you have to give a particular insured a little more attention than normal, than that's your job. The insured who has suffered the loss probably is not too concerned with your production quota for any given day.

I would agree that adjuster's do have a duty to try and reach an agreed price with the insured's contractor, and I do not have a problem with that. (Now that may change when you are speaking about a CAT situation, which as a local adjuster I have not been involved in.) The discussion as I follow it here is that we as adjusters are not out to give away the farm to a contractor who wishes to retire on the above listed job. |

The problem that I see over and over is contractor's throwing out a bid and seeing if it sticks. I just received a $70,000.00 estimate for a motel fire. It involved one room totaled, painting and general cleaning up in two others, and some exterior painting. After writing up my scope and estimate I came up with $32,000.00. Do we see a problem here? |
