THANK YOU!!!!! I agree 100%.....the HO-3 4/91 policy is one of indemnity and there is nothing about abandonment.....except as it relates to the abandonmant of the risk to the Company.....If the insured has 1/2 x 2 redoak plank under the carpet, and it is damaged, you owe it to the insured to replace the red oak plank......Oh and Jennifer, it's Joe....please, not Jim...

If you read the policy this one is simple. The insured is entitled to like kind and quality. We do not tell an insured that they have to replace their cooper gutters is aluminum or if their roof deck is t&g 2 by 6 that they have to accept osb board. If an insured agrees to a regular sub floor then that is their option.
